M23-103

January 16, 2014: With the chamber empty, following two days of lengthy negotiations during consensus-building sessions and meetings of group leaders within the National Constituent Assembly, a new amendment to Article 103 was proposed on Thursday, January 16, 2014, at 4:20 p.m., offering a compromise that should satisfy everyone. The amendment stipulates that “judges are appointed by presidential decree based on the approval of the High Council of the Judiciary. Senior magistrates are appointed by presidential decree, after consultation with the head of government, based on exclusive nominations proposed by the High Council of the Judiciary. The law shall define which positions constitute senior offices.”
